Background:
Rezoning case BAZ 1955 (A-1 to RS-1) was approved by the Broken Arrow City Council on April 19, 2016, subject to right-of-way and utility easement being dedicated along South 140th East Avenue. On June 23, 2016, the document providing six feet of additional right-of-way along South 140th East Avenue was recorded in Tulsa County as Document #2016058594 along with Document #2016058595 that provided a 17.5-foot wide utility easement.

Zoning Change: A-1 (Agricultural) to RS-1 (Single-family residential District).

Acreage: 2.50 acres

Legal Description for A-1 to RS-1

Part of the East Half of the Southwest Quarter of the Northeast Quarter (E/2 SW/4 NE/4) of Section Thirty-three (33), Township Eighteen (18) North, Range Fourteen (14) East of the Indian Base and Meridian, Tulsa County, State of Oklahoma, according to the U.S. Government Survey thereof, described as follows, to-wit:

BEGINNING at a point 825 feet East of the Southwest corner of the Northeast Quarter (NE/4) of said Section Thirty-three (33); Thence East 237.5 feet; Thence North 460 feet; Thence West 237.5 feet; Thence South 460 feet to the POINT OF BEGINNING.

be and the same is hereby changed from the zoning classifications of A-1 to RS-1.

Staff recommends that the Council adopt Ordinance No. 3470 and approve the Emergency Clause.
