Background:
Developer has requested a letter of release so that a proposed development located outside the city limits of Broken Arrow, but within the fence line, may be served by Rural Water District 5.
Sec. 24-27. - (Water Service to customers outside the city limits) of the City of Broken Arrow Code of ordinances states the following:
“The city may, at the discretion of the city manager, provide water service to customers outside the city limits; providing that a city owned water main, with sufficient capacity, is within the boundaries of or in right of way abutting the property to be served.”

Water and sanitary sewer service capacity are not available to serve this area. There are no City service lines within the boundaries or right of way abutting the property.
