Approval of and authorization to execute Change Order No. 1 with Diversified Civil Contractors, LLC, for construction contract ST1928; West New Orleans Street and Elm Place Intersection and Streetscapes Improvements

Background:
ST1928 West New Orleans Street and Elm Place Intersection and Streetscape Improvements include replacement of the interior intersection with a decorative full depth concrete pavement utilizing colored/patterned concrete and pavers. The existing asphalt pavement beyond the intersection proper will be milled and overlaid extending approximately 400 feet in each direction from the center of the intersection.
Construction of the project also includes construction of waterline; 5' wide concrete sidewalk; 10' wide concrete trail; landscaping; hardscaping; irrigation; New Orleans Square gateways; street lighting; and traffic signal replacement.
The final plans and contract documents were advertised for bid on April 19 and April 26, 2022. Bids were opened on May 10, 2022 with the lowest responsible bidder being Diversified Civil Contractors, LLC with a Total Bid of $4,465,993.50. Subsequently the Construction Division issued Notice to Proceed on the project for June 6, 2022 with a 300 calendar day construction timeline.
This Change Order No. 1 pertains to the following Scope/Time Changes:
During the review of the "Warm" and "Cool" tone color selections within the City of Broken Arrow City Council Meeting agenda item on June 6th, 2022, it was determined that additional color iterations were to be developed by the Engineer of Record on the project and supplied for review by Council on June 20th, 2022. Due to this delay, the critical path of the project has been delayed since May 30th when the City issued a hold on as bid colored products for the project.
