Background:
As political subdivisions of the State of Oklahoma, the City of Broken Arrow (City) and Wagoner County (County) each have certain responsibilities and duties regarding the ownership, operations, maintenance, construction, and financial obligations with respect to public rights-of-way, specifically those with public transportation facilities and stormwater\drainage systems that serve those transportation facilities. Each governmental entity is statutorily obligated to provide certain responsibilities and duties accordingly to its governing statutes.
In certain situations, the City and the County share these responsibilities and duties along a single public transportation facility. In these shared situations, it is difficult to accomplish the necessary aspects of each entity's responsibilities and duties. In an effort to better define each agency's role and to provide clear distinction for each entity's responsibilities and duties, the City and the County have mutually agreed to enter into an Inter-local Agreement that specifically designates each agency's obligation regarding the public rights-of-way along these transportation facilities in and around the City of Broken Arrow.
Both entities understand and expect that this Agreement may be updated in the future as each entity grows and expands its public rights-of-way. The intent is simply to revise Exhibit A, the attached map, as this growth occurs. Staff recommends approval and authorization to execute the Inter-local Agreement.
