Background:
Rezoning case BAZ-2044 (CG to CG & IL) and PUD-297, which contains 2.21 acres, was approved by the Broken Arrow City Council on January 21, 2020. The City Council approved BAZ-2044 & PUD-297 subject to City Council approval of BACP-166 and the applicant returning in one year to give an update on the business. BACP-166 was approved by the City Council on January 7, 2020 and the property owner presented an update to City Council on May 17, 2022. The property is generally located west of the southwest corner of New Orleans Street (101st Street) and Elm Place (161st E. Avenue).

Staff recommends that the Council adopt Ordinance No. 3736 and approve the Emergency Clause.
