Title
Consideration, discussion and possible adoption of Ordinance No. 3733 amending the Broken Arrow Code of Ordinances, Chapter 10 Fire Prevention and Protection, Article I - In General; Section 10-3 - Manufacture, sale, use, etc. of fireworks; Repealing all ordinances to the contrary; and declaring an emergency

Background:
The Council directed City Staff to address issues related to the use of fireworks over the July 4 holiday. Specifically, the council was concerned about issues related to fire safety and the amount of fines and costs associated with a violation.
Staff held meetings to address these issues and the attached preview ordinance was drafted. Following input from Council, the ordinance proposed for final adoption changes current City Ordinance in the following respects:
• The holder of any permit shall have an appropriate extinguishing agent available during discharge of fireworks;
Otherwise the ordinance remains unchanged. Any violation for the sale or use of fireworks is still punished by a fine of 250.00. Possession of fireworks at any other time than that provided for in ordinance shall be punished by a fine of $500.00.
