Background:

Bonnie Gorrell is dedicating a 17.5-foot utility easement to fulfill conditions of approval for rezoning and lot split requests BAZ-2108 and BAL-2168.

BAZ-2108 was recommended for approval by the Planning Commission on May 12, 2022, subject to a 17.5-foot utility easement being dedicated along East 96th Street South. BAL-2168 was conditionally approved by the Planning Commission on May 26th, 2022, subject to City Council approval of BAZ-2108 and a 17.5-foot utility easement being dedicated along East 96th Street South. This utility easement dedication for the entire frontage of both unplatted lots satisfies these conditions.

The dedication of the 17.5-foot-wide utility easement described in the utility easement dedication has been reviewed by Staff and is recommended for acceptance.
