Background:
McGuire Bell Lago, LLC is amending an off-site water line easement which was dedicated for the purpose of providing utility access to the proposed Villas at Bel Lago II development. This easement was first dedicated to the City of Broken Arrow on August 4, 1980 and is recorded in Wagoner County in Book 558, Page 659-660. This amended easement document removes language from the previous document that requires the City to pay all damages to fences, crops and premises which may be suffered by reason of laying, relaying, maintaining, operating, or removing said water lines.
The amendment to the text of the 50-foot wide water line easement shown in exhibit A has been reviewed by Staff and is recommended for acceptance.
