Background:
The Museum Broken Arrow (MBA) is located in a city-owned building at 400 S. Main Street. MBA received a Keep Oklahoma Beautiful, Inc. grant to install a mural on the south exterior side of the building located at 400 South Main Street, Broken Arrow, OK. The museum board formed a committee to discuss mural designs, artist selection, and fundraising and held a contest to choose the final mural design to be painted on the approximately 2,000 square feet of the building's exterior wall. The artist selected to paint the mural is Carlos Barboza.
The attached Agreement permits Mr. Barboza to paint a mural on exterior wall of 400 South Main Street, known as The Museum Broken Arrow. Highlights of the Use Agreement include:
1. The City and Museum authorize Artist to paint a mural on the outside South wall of the building located at 400 South Main Street, Broken Arrow, OK.
2. The Museum will undertake and pay for any modifications or improvements to the wall or other structures of the building needed to accommodate the mural.
3. City has absolute final decision in approving the mural.
4. The City shall have the sole right and responsibility to maintain the mural for ten (10) years and artist grants the license to do so.
5. Artist's fee shall be $33,789 inclusive of all costs associated with the mural and shall be paid solely by the museum.
6. City and Museum shall have the right to replace the mural with a different mural based upon the same, or a different historical theme as the original mural.
The artist will commence work on the mural upon execution of this agreement with completion on or before May 25, 2021.
