Background:

The City of Broken Arrow and Broken Arrow Senior's Center ("BASI") have entered into multiple annual Parks and Recreation Use Agreements regarding the Senior Center located at 1800 South Main Street in Broken Arrow, with the most recent and current agreement having been executed on June 15, 2020 ("Existing Agreement"). In addition, the City has acquired real property located at 1811 South Main Street in Broken Arrow for the purpose of constructing a building to be used as a Senior Citizen's Activity Center ("Activity Center").

The City and BASI intend to enter into a Parks and Recreation Use Agreement similar to the Existing Agreement applicable to the Activity Center prior to completion of construction. Article III of the Existing Agreement requires the prior written approval of the Director of Parks and Recreation ("Director") for the addition of improvements, structures or fixtures upon the property. In addition, Article III of the Existing Agreement further provides that any such authorized improvements, structures or fixtures "shall become the property of the City upon the termination of this Agreement unless the City gives prior written permission for their removal".

BASI has indicated their desire to recognize donors contributing to BASI for the new Senior Center Activity Center by placing plaques at the Activity Center.
