Background:

On December 6, 2018, the City of Broken Arrow entered into an agreement with the Oklahoma Department of Transportation (ODOT), to gain access to ODOT’s right of way along the Broken Arrow Expressway, as part of the City of Broken Arrow’s beautification initiative. The beautification initiative includes maintenance of stormwater drainage and improving the visibility along the corridor. Improved visibility required the removal of trees or any other type of overgrowth along the fence line.      

During the tree removal process, tree trunks intertwined with the fences needed to remain until the City of Broken Arrow entered into another agreement with ODOT for the removal and replacement of the fence. Per the agreement, ODOT will furnish all fencing materials needed to install the sections of fence identified for removal and replacement, and the City of Broken Arrow is responsible for the installation of said sections of fence.

 A bid was opened for a contract to repair the fence along the Broken Arrow Expressway for the Stormwater Division of the Streets and Stormwater Department on September 11, 2019.  Bids from two (2) vendors were received.

Following the opening of bids, staff discovered that the lowest bid from Stronghand LLC., did not meet specifications, as they failed to submit the required insurance information. The other bid from Aaron Fence Co. exceeded the cost estimate substantially, and therefore the Streets and Stormwater Department requested that this bid be rejected and a new bids prepared. On November 5, 2019, City Council rejected bid 20.108.

A new bid was opened on December 11, 2019 for the contract to repair the fence along the Broken Arrow Expressway for the Stormwater Division of the Streets and Stormwater Department. Bids were sent out to nine (9) vendors and four (4) bids were received.

The bid specifications inform bidders that the City shall evaluate bids in response to the solicitation and will award the bid to the bidder whose bid is determined to be the lowest responsive, responsible bid. Additionally, the City may waive informalities or minor irregularities in bids received.

Base pricing of the fencing are reflected in the attached bid tabulation sheet.  The bid tabulation includes all vendors who submitted bids for the fencing.

Staff recommends awarding the lowest responsible bid to Empire Fence for the Broken Arrow Expressway fence repair contract, and therefore, recommends the purchase.
