Title:

title

Consideration, discussion, and possible preview of an Ordinance amending the Broken Arrow Code of Ordinances, Chapter 16-Offenses, Article I-In General, Section 16-3.1 Domestic Abuse; arrest without a warrant; repealing all Ordinances to the contrary; and declaring an emergency

Background:

Oklahoma House Bill 2630 changed the definitions for “family or household members” and added the definition for “intimate partner” within the context of domestic violence charges.  In addition, changes have been made allowing for police officers, having probable cause to believe domestic violence has occurred, to make arrests within 72 hours, which was increased from the previous 48 hour rule. Lastly, the updated statute changed the age limit that a defendant can be charged for domestic abuse to 13 years of age. The proposed changes to the City of Broken Arrow’s Ordinances will bring them in line with the new Oklahoma State Statutory definitions listed in 22 O.S. Section 60.1, et. seq.
