Background:
The right-of-way acquisition for the 23rd Street, Houston to Kenosha widening project has been approved for federal Surface Transportation Program (STP) funding, to be cost shared 20%-80% (City-Oklahoma Department of Transportation (ODOT)). The City's Right-of-Way Agent and Legal Department have negotiated a payment of $31,700.00 plus costs and fees of $22,500.00, with B-Z Properties, LLC, the property owner of Parcel 19, which consists of 0.54 acres generally located north of the Northeast Corner of 23rd Street and Sidney Avenue in the Northwest Quarter of Section 7, Township 18 North, Range 15 East. In accordance with a February 10, 2014, Project Construction, Maintenance, Utility Relocation, and Right-of-Way Agreement between the Oklahoma Department of Transportation and the City of Broken Arrow, the City will make the payment to the property owners and apply for reimbursement of ODOT's 80% share.

A copy of the signed acceptance of the City's offer is attached, as is the General Warranty Deed. Payment of the compensation amount is on the August 20, 2019 City Council Claims List.
