Background:

Kenneth Barbee is dedicating right-of-way for purposes of fulfilling conditions of approval for BAZ-2021 (Rezoning) and BAL-2055 (Lot Split). BAZ-2021 was approved by the City Council on February 5, 2019, subject to right-of-way and utility easements being dedicated. BAL-2055 was conditionally approved by the Planning Commission on July 11, 2019 subject to right-of-way and utility easements being dedicated and the warranty deed for each parcel being brought to the Plan Development Division to be stamped prior to recording in Wagoner County.

 

The total 50-foot right-of-way (24.75-feet statutory and 25.25-feet dedication) is shown on the attached exhibit and is located along the 51st Street (Evans Road) frontage of the lot.

 

Staff has reviewed the documents and recommends acceptance of the deed of dedication.
