On June 27, 2019, a rezoning case was brought before the Planning Commission regarding the Indian Springs Manor Addition which is currently zoned residential multi-family. The RM zoning was approved by the City Council on January 17, 1972, as part of BAZ-307, which was part of four rezoning applications in the area.  On January 20, 1972, Ordinance 416 was approved by the City Council that changed the zoning on the property from R-1 to R-5.  On February 1, 2008, the Zoning Ordinance was updated and the R-5 district was changed to RM.  When the Zoning Ordinance was updated in 2008, one of the changes made was that single-family detached was no longer a use permitted in the RM district.  As a result, the single family detached use on the property is classified as a “Legal Nonconforming Use”.

 

It has come to Staff’s attention that there several properties within the city in which their primary use does not correlate with their assigned zoning district. Staff would like direction from the Planning Commission to analyze these areas and bring forward a recommendation for possible rezoning.
