Background:
The City of Broken Arrow has been a member of the Tulsa County CDBG Urban County since it was formed in 2008. Tulsa County is the lead entity for the Tulsa County Urban County and as such has initiated the process of requalification with the Department of Housing and Urban Development (HUD) to receive funds as an Urban County for the period of FY2020-2022. This will be the fifth requalification period for the Tulsa County Urban County.
Attached is the original Cooperation Agreement executed by Tulsa County and the City of Broken Arrow in 2007. The original Cooperation Agreement contains an automatic renewal provision, so we do not need to execute a new agreement each requalification period. However, for this requalification period HUD has imposed a new requirement that existing Cooperation Agreements with automatic renewals also contain a provision that units of local governments located within an urban county are prohibited from the "sale, trade or otherwise transfer CDBG funds for unrestricted local funds." This is not a practice that the Tulsa County Urban County members engage in, but the Cooperation Agreement must be amended to contain this provision. Tulsa County must submit the requalification documents including the amended Cooperation Agreements of all eleven Tulsa County CDBG Urban County members to HUD by mid-June.
