Background:
Title 11, Section 11-44-101 provides that the governing body of the municipality shall provide by ordinance for the appointment of a Board of Adjustment. Title 11 O.S. Section 45-102, requires the nomination of all members of the Planning Commission to be made by the Mayor and confirmed by the governing body of the municipality. In 2017, the Council found it important to have input on such appointments and adopted a policy governing the nomination process for the Planning Commission Members and the Board of Adjustment Members. To be in compliance with State Law, Staff is recommending that Council repeal the 2017 nomination policy and amend the ordinance governing the Board of Adjustment nomination process. Additionally pursuant to State Law, the Mayor will make all nominations for the Planning Commission and the governing body will confirm such nominations.
