Background:
The attached General Warranty Deed is being conveyed to the City of Broken Arrow, a municipal corporation, from Dawson Enterprises, LLC, an Oklahoma limited liability company, the owner. Parcel 10a consists of 10,033 square feet (SF) of permanent Right-of-Way, Parcel 10b consisting of 450 SF of Temporary Construction Easement and a Parcel 10c consisting of 6,533 SF of Drainage Easement for 37th Street Improvements, Albany to Houston, located in the Southeast Quarter of Section 7, Township 18 North, Range 15 East, Wagoner County, State of Oklahoma. Dawson Enterprises, LLC has accepted the following offer, made subject to City Council approval:
Permanent Right of Way, Parcel 10A: 10,033 square feet (SF) @ $0.55 SF = $5,518.00
Drainage Easement, Parcel 10C: 6,533 SF @ $0.55 SF x 40% = $1,437.00
Temporary Construction Easement: 10B Rental Period for 12 months:
450 SF @ $0.55 SF x 8% = $20.00
Damages: Pavement, Fence, Brick, Sign relocation $3,681.00
Total Just Compensation: $ 10,700.00

A copy of the signed acceptance of the City's offer is attached, as is the General Warranty Deed, Drainage Easement and Temporary Construction Easement. Payment of the compensation amount is on the May 7, 2019 City Council Claims List.
