Background:

The owner, Linda Philpott, has submitted an application requesting the closure of approximately 0.01-acre utility easement on property located approximately one-quarter mile south of Florence Street (111th Street) and one-quarter mile west of Elm Place (161st Street) at 5205 S. Lions Avenue. The property is platted as Lot 16, Block 9, Windsor Estates and the utility easement was recorded as part of the plat.

According to the applicant, the home was built in 1983. The applicant purchased the property in 1993 when a survey of the property was completed and showed no encroachment into the utility easement. Upon trying to sell the property, the applicant had another survey conducted, by the same company, which found that the home encroaches into the south, side yard utility easement by approximately 2.25 feet. The applicant proposes to close a 0.01-acre utility easement in order to facilitate selling the property.

Staff has reviewed the documents and recommends acceptance of the utility easement closure. AEP/PSO, Windstream, ONG, and COX have no objections to closing the easement.
