Background:
An informational letter sent to the landowner on July 31 2018, detailing the improvements, introducing the right of way agent along with a donation certificate, owner contact form along with property exhibit. On 10/24/18, an offer letter based on market analysis sent to the landowner for a Utility Easement and Temporary Construction Easement for $6,860.00. On 11/18/18, Mr. Forbes contacted the City advising his counter offer was $20,000.00, refusing the City's offer and advising the temporary easement would not exceed 45 days. The City's right-of-way agent has attempted unsuccessfully to negotiate with Asa Forbes for Parcel 16.0, 16.1, generally located at 11406 S 193rd E Avenue, Broken Arrow, Oklahoma, Section 36, Township 18 North, Range 14 East. The attached Resolution of Necessity No. 1188 authorizes that condemnation proceed on Parcel 16.0, and 16.1, for a Utility Easement and Temporary Construction Easement.

Cost: $5,157.00 plus costs
