Background:

Several attorneys with the law firm of Hall Estill, including Ken Williams, John Heil, Jim Milton and Bryan Nowlin, currently represents the City in various legal matters. The City is also a party to a lawsuit against the manufacturers and distributors of opioid prescription drugs and other related defendants, including Mallinckrodt, LLC and Mallinckrodt, PLC.

The law firm of Hall Estill recently advised the City that it has been asked to serve as local counsel and represent Mallinckrodt, LLC and Mallinckrodt, PLC in the lawsuit filed by the City against the opioid defendants. Hall Estill has requested that the City agree to a limited conflict of interest waiver to permit Hall Estill to serve as local counsel for the Mallinckrodt defendants in the opioid lawsuit. Hall Estill has an Ethical Wall which prevents any lawyer or staff member working on the City’s matters from having any communications regarding confidential matters with any attorneys or staff working on the opioid case.

The attached Waiver of Conflict of Interest provides that the City waives its right to assert a potential conflict of interest so that Mallinckrodt, LLC and Mallinckrodt, PLC may continue to be represented by Hall Estill attorneys.
