Ratification of Workers’ Compensation Settlement for Barry Pickup, current Police Department employee

Background:
On December 18, 2018, City Council authorized staff to settle a workers’ compensation claim for Barry Pickup, a current employee of the Police Department. This settlement is presented for the City Council’s ratification.
On June 26, 2015, Mr. Pickup claimed cumulative trauma to both knees from repetitive activity. The City denied the claim due to pre-existing issues and for lack of identifiable or significant aggravation. The appointed physician found causation of 50% work related and 50% non-work related. The City was advised that the claimant wanted to settle. Settlement was recommended for both knees on a denial or an order denying that the need for medical care is related to job activities and that they are pre-existing.
On December 20, 2018, the claimant accepted a settlement on a denial with a common law release and agreement not to appeal. The order denied the claim and indicated that the claimant’s injury to both knees and need for knee replacement is due to non-work related issues.
The sum of $25,000 was paid to the claimant. The sum of $140.00 was paid to the Workers’ Compensation Commission.
