title
Consideration, discussion, and possible termination of an existing Agreement between the City of Broken Arrow and Mark’s Rose Care
End
Background:
On July 17th, 2018, City Council approved an Agreement between the City of Broken Arrow and Mark’s Rose Care for maintenance and care of the rose beds in the Rose District. We have been informed that the owner and operator of Mark’s Rose Care, Anthony Mark Stelljes, has recently passed away. Parks Department Staff has reached out to the Mr. Stelljes’ work associate to confirm Mark’s Rose Care will no longer be able to fulfill their obligations of the Agreement.
The estimated cost of the agreement was $31,114.80 to be paid. To date Mark’s Rose Care has been paid $15,560.40.
The agreement allows the City to terminate the agreement at any time, without prior notice, due to poor service, budget shortfall, or any other unspecified reason. Due to the importance of consistent maintenance and care of the roses in the Rose District, Staff is requesting that the City Council terminate the Agreement with Mark’s Rose Care.
