Approval of and authorization to execute a Parks and Recreation Use Agreement between the City of Broken Arrow and the Broken Arrow Softball Club, Incorporated (BASCI)
End
Background:
The attached use agreement grants a non-exclusive license to allow Broken Arrow Softball Club (BASCI) to use the Al Graham Softball Fields located at the Indian Springs Sports Complex (Premises). The use of the Premises is to allow BASCI, a registered non-profit organization, to operate an adult softball program to the citizens of Broken Arrow.
Use Agreement Highlights:
• A Stay to Play clause has been added to the Use Agreement.
• BASCI will pay $9.00 to the City of Broken Arrow:
o Per regular season, scrimmage, and or tournament game
o Per two hour clinic, camp, training session, and or try-out
• BASCI shall be responsible for scheduling the use of the premises to all third party users and the City of Broken Arrow will receive a per game fee from BASCI regarding all third party rentals.
• BASCI will supply all supporting staff to operate a successful adult softball program.
o Not limited to registration, umpires, conflict resolution, and etc.
• It is required by BASCI to submit a written schedule of actual usage dates and times to the Parks and Recreation Director or his/her designee.
This use agreement will commence upon execution and end on December 31, 2021.
