Background:

The attached General Warranty Deed is being conveyed to the City of Broken Arrow, a municipal corporation, from Roger Poffen, the owner. Parcel 11a consists of 8080 square feet of permanent Right-of-Way and a Temporary Construction Easement for Parcel 4.1, which consists of 450 square feet for 37th Street Improvements, Albany to Houston, located in the Southeast Quarter of Section 7, Township 18 North, Range 15 East, Wagoner County, State of Oklahoma. Roger Poffen has accepted the following offer, made subject to City Council approval:

 

Permanent Right of Way:  Donation

Temporary Construction Easement: Donation

Damages (Ornamental fence replacement): $66,495.00

Total Just Compensation Amount (Rounded) = $ 66,500.00

 

A copy of the signed acceptance of the City’s offer is attached, as is the General Warranty Deed and Temporary Construction Easement. Payment of the damages amount is on the November 5, 2018 City Council Claims List.

Funding Source:       Funding for this project is from the G.O. Bond 2014.
