Acceptance of a Utility Easement from the Martha A. Helm Trust, on property located one-half mile north of Houston Street, west of Evans Road, Wagoner County, State of Oklahoma (Section 08, T18N, R15E)

Background:

The owner, Martha A. Helm Trust, has submitted an application requesting the acceptance of a 17.5 foot wide utility easement along the west side of Evans Road for the entire street frontage of the property.

The owner is submitting applications for the dedication of right-of-way and utility easements along the street frontage of the property in response to conditions placed on the approval of BAZ-2004 and BAL-2032. BAZ-2004 was approved by the City Council on July 17, 2018, subject to right-of-way and utility easements being dedicated along Evans Road in accordance with the Subdivision Regulations. BAL-2032 was approved by the Planning Commission on August 9, 2018 subject to the conditions of BAZ-2004 being met and warranty deeds for both parcels being brought simultaneously to the Plan Development Division to be stamped prior to being recorded in Wagoner County.

Staff has reviewed the documents and recommends acceptance of the utility easement.
