Approval of and authorization to execute a Professional Services Agreement between the City of Broken Arrow and Hall Estill, Attorneys at Law for providing counsel and legal advice regarding water related issues

Background:
Hall Estill is a well-respected law firm with vast experience in water related issues. The Acting City Attorney is recommending retention of this firm to provide counsel and legal advice to the City regarding water related issues and case-by-case basis.
The attached Professional Services Agreement memorializes retention of the firm, costs and the hourly rates to be charged. The firm charges the following rates:
James Milton: $295.00 per hr. maximum
D. Kenyon Williams, Jr.: $295.00 per hr. maximum
Bryan J. Nowlin: $295.00 per hr. maximum
Peggy S. Holmaas: $175.00 per hr. maximum
Routine costs such as copying and postage are addressed in the Agreement. Costs and fees for this matter are capped at $100,000.00 and it will expire June 30, 2019.
Cost: Not to Exceed $100,000.00
