Background:
The owner, Joshua Herron, has submitted an application requesting the closure of approximately 17.44-acres of an existing (approximately 43.79-acre) overland drainage easement. The existing overland drainage easement was recorded in Wagoner County on August 4, 2005 as document number 2005-12181 in Book 1511, Page: 766-772. The dedication of the overland drainage easement occurred while the property was being used as Glen Eagles Golf Course and most likely included the entire property in an effort to simplify the project.
Mr. Herron purchased the property with the intention of constructing a home, but discovered that the entire property had been dedicated as an overland drainage easement. Mr. Herron has met with Staff and it has been determined that portions of the property can be removed from the overland drainage easement. The portions not closed by this ordinance will remain in effect.
In exchange for the closure of portions of this overland drainage easement, Mr. Herron has agreed to dedicate right-of-way and utility easements along Dearborn Street and 37th Street. These documents are under review by Staff and will be brought before the City Council for dedication at the same meeting as the ordinance for this closure request.
Staff has reviewed the documents and recommends acceptance of the overland drainage easement closure.
