Acceptance of an Amendment to the Deed of Dedication and Restrictive Covenants of the Tee Town Golf Ranch Plat, located east of 37th Street, one-third mile south of Kenosha Street, Wagoner County, State of Oklahoma (Section 31, T19N, R15E)

Background:
The plat for Tee Town Golf Ranch was recorded in Wagoner County on June 5, 2002 (PT02-102). The recorded plat includes use and development restrictions within the covenants that limit the use to outdoor recreation facilities and to uses accessory to a golf driving range. The covenants allow for the restrictions to be amended or terminated by written instrument and signed by the Planning Commission, its successors, and owners of a majority of the lots within the subdivision.
On October 17, 2017, the City Council approved a Specific Use Permit (SP-285) for a place of assembly for The Ridge at Broken Arrow on the site platted as Tee Town Golf Ranch. One of the conditions of approval for SP-285 required the applicant to draft a separate written instrument for the Planning Commission’s signature to amend the use restrictions on the plat and record it with Wagoner County. The language within the amended plat restrictions allow for any and all uses permitted by the underlying zoning of the property. Acceptance of this request and recording the amendment with Wagoner County will satisfy said condition of approval included with SP-285.
