Background:
On July 2, 2001, the City Council approved Resolution 318 authorizing the City of Broken Arrow to extend Joliet Street within the Oklahoma Department of Transportation (ODOT) Right of Way and requiring the City of Broken Arrow to maintain this street. According to the Resolution, the City of Broken Arrow would have the street constructed at its sole expense and will thereafter maintain the street at its sole expense without further obligation or cost to ODOT. From the aerial photo and the drawing submitted with the resolution, it did not appear there was enough room to construct this road without going onto the school district's property. The school district had no plans or obligations to construct this street as part of their improvements to the maintenance facility. The property abuts 15th Street on the west.

On April 15, 2014, City Council approved Broken Arrow Public School's rezoning request, BAZ-1913, with the recommendation that platting be waived provided at least 30 feet of right-of-way be dedicated along 15th Street.

Staff recommends that the Council accept Resolution 1060, accepting the General Warranty Deed.
