                     Approval of and authorization to execute First Amendment to Site Lease Agreement and Memorandum of First Amendment to Site Lease Agreement with New Cingular Wireless, PCS, LLC

Background:

On July 7th 1997, the City of Broken Arrow entered into a Site Lease Agreement with New Cingular Wireless PCS, LLC (“Lessee”).  The Lessee is the successor in the interest to the Original lease for tower and ground space located at Boston and Lions.

 

The terms of this lease were for an initial five years with three additional five year automatic renewals.  This amendment provides for four additional five year renewals.  The Lessee’s current rent is $4,800.00 per year and will increase to $20,400.00 per year.  This will result in an increase of $15,600.00 over the existing contract. The amendment also provides a fifteen percent increase for each of the five-year renewals.
