Background:
Stephen Bugg with the law firm of McAfee & Taft, P.C., is a well-respected attorney with vast legal knowledge and experience involving sovereignty law. Charlie Plumb is also a well-respected attorney with the firm and has vast legal knowledge and experience involving labor and employment law. The Human Resource Director and the City Attorney is recommending that the Council engage this firm to provide counsel and legal advice to the City regarding employment and labor issues and sovereignty law related issues. Retention is recommended due to the firm's expertise in these areas.

The attached Professional Services Agreement memorializes retention of the firm, costs and the hourly rates to be charged. The firm charges the following rates:

Employment/Labor Law Sovereignty Law
Shareholders: $305.00 per hr maximum $305.00 per hr maximum
Associates: $205.00 per hr maximum $215.00 per hr maximum
Paralegals: $105.00 per hr maximum $95.00 per hr maximum
Arbitration $250.00 per hour maximum N/A

Routine costs such as copying and postage are addressed in the Agreement. Costs and fees for this matter are capped at $100,000.00 and it will expire on June 30, 2018. Staff recommends that the Council approve the Agreement and authorize its execution.

Cost: Not to exceed $100,000.00
