Approval of and authorization to execute Amendment No. 1 to the Water Supply Agreement for Permanent Service between Broken Arrow Municipal Authority, City of Broken Arrow, Oklahoma and the Tulsa Metropolitan Utility Authority and City of Tulsa, Oklahoma
End
Background:
In January 2011 the Broken Arrow Municipal Authority entered into a 40 year agreement to purchase up to a maximum of 20 million gallons of water per day with an average daily take anticipated around 5 million gallons a day. This agreement was made in anticipation of the planned connection and the installation of the master meter along Dearborn Street (East 41st Street South). This project has been completed and the connection is active.

In May of 2016, a second connection was made with City of Tulsa and has been placed in service. The master meter at the second connection consist of three (3) 10 inch meters and is located East of 61st Street and south of 129th East Avenue.

The Amendment No. 1 sets in place the volume of water as BAMA shall require up to but not in excess of BAMA's Maximum Agreement Demand and TMUA's obligation to deliver.

The Exhibit A (attached) table has a schedule of use from 2013 up to 2053 with an average day use of 1.0 mgd and a maximum daily use of 5.0 mgd.

Both of these Tulsa connections shall be turned on only in the event of an increased system need that exceeds about 20 mgd produced by the Verdigris Water Treatment Plant. At present time the two Tulsa connections are turned on intermittently between June and September.
