Consideration, discussion, and possible adoption of Ordinance No. 3490-Corrected, amending Chapter 16, Offenses-MISCELLANEOUS, Article III, Offenses Against Property, Section 16-56, Petit Larceny, amending the definition of Petit Larceny to be the taking of personal property of a value not to exceed $1,000, amending the maximum punishment to be imprisonment of not more than 30 days, of the Broken Arrow Code; repealing all ordinances to the contrary; and declaring an emergency

Background:
On July 1, 2017, State law is being amended with regard to the Larceny of Merchandise held for sale in retail or wholesale establishments. Our current ordinance provides that Petit Larceny is the taking of personal property of a value not to exceed $500. State law has now amended the value not to exceed $1,000. Also, the maximum punishment is now imprisonment of not more than 30 days. These are the changes indicated in the preview ordinance. In order to address publication issues, Staff recommends adopting the ordinance and approving the emergency clause.
