                     Approval of and authorization to execute First Amendment to Amended and Restated Site Use/Lease Agreement with New Cingular Wireless, PCS, LLC

Background:

On July 19, 2016 the city of Broken Arrow entered into an Amended and Restated Site Use/Lease Agreement with Southwestern Bell Mobile Systems Inc.  The Lessee is the successor in the interest to the Original lease for tower and ground space located on the 170-foot tower located on Tiger Hill.

 

The terms of this lease are for an initial five years with three additional automatic five years renewals.  The Lessee shall pay rent in the amount of $2,000.00 with a fifteen percent increase for each five-year renewal.

 

The Lessee wishes to modify their existing Site Use/Lease Agreement by removing certain existing equipment and adding new equipment as outlined in exhibit A of the attached First Amendment to Amended and Restated Site Use/Lease Agreement. 

 

 In consideration for this amendment New Cingular Wireless PCS, LLC has agreed to a $305.00 per month increase to their existing $2,000.00 per month rent in the contract.
