Approval of and authorization to execute Resolution No. 1018, a Resolution authorizing the acceptance of a General Warranty Deed for Parcel 12, which consists of 0.28 acres of Permanent Right-of-Way for 23rd Street Widening from Houston to Kenosha, in the W 1/2 of Lot 1, Block 2, Angus Acres Subdivision, in Section 7, Township 18 North, Range 15 East, Wagoner County, from the Mark S. Drop, Sr. Living Trust dated 1991, and authorization of payment in the amount of $28,500.00 to the Mark S. Drop, Sr. Living Trust dated 1991, for the 23rd Street Widening from Houston to Kenosha Project and authorizing staff to apply to the Oklahoma Department of Transportation for reimbursement of eighty percent of the acquisition cost of this property for the 23rd Street Widening from Houston to Kenosha Project (Project No. ST0914)

Background:
The Right-of-Way acquisition for 23rd Street, Houston to Kenosha Widening project has been approved for Federal Surface Transportation Program (STP) funding, to be cost shared 20%-80% (City-Oklahoma Department of Transportation (ODOT)). The City's contract right-of-way agent, Universal Field Services has negotiated a payment of $28,500.00 for right-of-way with The Mark S. Drop, Sr. Living Trust dated 1991, the property owners of parcel 1w, which consists of .28 acres, in the W 1/2 of Lot 1, Block 2, Angus Acres Subdivision, in Section 17, Township 18 North, Range 15 East, Wagoner County. In accordance with a February 10, 2014, Project Construction, Maintenance, Utility Relocation, and Right-of-Way Agreement between the Oklahoma Department of Transportation and the City of Broken Arrow, the City will make the payment to the property owners and apply for reimbursement of ODOT's 80% share.
