Background:
The attached use agreement grants a non-exclusive license to allow R.C. Dickenson Family YMCA of Greater Tulsa (YMCA) to use the Family Aquatic Center and associated facilities (Premises) located at 1400 South Main Street in Broken Arrow for swim lessons. The goal of this Agreement is not only to teach a lifesaving skill to children but to increase programming and usage of the Family Aquatic Center for the benefit of the public, YMCA members, and the City of Broken Arrow.

Highlights of the contract include.

* YMCA agrees to hire all staff to operate a swim lesson program, including current certified swim instructors and or current certified professional rescuers.
* YMCA agrees to all phases of operating a swim lesson program, including but not limited to patron registration, complaint resolution, and advertising.
* YMCA will charge a flat fee of $45 for all patrons participating in the swim lessons.
* YMCA will be responsible to supply one certified lifeguard to monitor participants.
* YMCA will retain all program fees to help offset the operating cost of the swim lesson program.
* YMCA will not be charged a user fee for programming at Premises.
* CITY will supply one staff member to open and close Premises.
o Estimated cost is $10.39 per hour for 180 total hours which equals $1,870.20 for the swim lesson season.
o Cost has increased from 2016 season due to additional program times in the morning hours.
* This will be the third year that the YMCA has operated swim lessons at this location.
