Background: Lots 5-12, Block 54, Original Town of Broken Arrow were purchased in 2014. The owner desired to construct four single family detached residential units on the property. City staff worked with the owner through the PUD process to prepare the 4 lots for development. The development is called BA Brownstones.
The garages are in the back of the lot and served by an existing alley. The alley dead-ends at the 3rd lot (lot 10) as it intersects with Rose District Overflow Parking Lot. This left the 4th lot (lot 11 and 12) without access from the alley. City staff agreed in purpose to allow a future residential development to provide access by means of a drive off of the west entry drive (Birch Street) to the overflow parking lot.
A residential structure has been built on Lots 9 and 10. Lots 11 and 12, 214 W. Dallas Street, was sold by the original owner to Scott Wise. Mr. Wise has an interested buyer who desires to build a residential structure on the lot and asked for the driveway access to be prepared under an agreement that would run in perpetuity with the property for driveway access to the west entry drive of the overflow parking lot as shown on the attached exhibit.
An access use agreement has been prepared to accommodate this development in the Rose District and use of City property for the driveway access.
