Approval of and authorization to execute Resolution No. 1009, a Resolution approving, authorizing and accepting a Contract for Sale of Real Estate for real property located at Lot 1, Block 6, amended plat of part of Angus Acres 2nd Addition, a subdivision of part of NW/4 of Section 7, Township 18 North , Range 15 East of the Indian Base and Meridian, Wagoner County, State of Oklahoma, including structures and improvements; and authorizing the City of Broken Arrow’s expenditure of the sum of $175,635.00 to Charles F. Cameron Living Revocable Trust to effect such purchase, for owner relocation and owner moving expenses, as well as reasonable and necessary costs; designating representatives of the City of Broken Arrow, Oklahoma for purposes of granting certain approvals and executing certain instruments as required under and in connection with said Contract for Sale of Real Estate; and authorizing City Staff to apply to the Oklahoma Department of Transportation for reimbursement of eighty percent of the acquisition of this property for the 23rd Street Widening from Kenosha to Houston Project (Project No. ST0914)

Background:
The Right-of-Way acquisition for 23rd Street, Houston to Kenosha Widening project has been approved for Federal Surface Transportation Program (STP) funding, to be cost shared 20%-80% (City-Oklahoma Department of Transportation (ODOT)). The City’s contract right-of-way agent, Universal Field Services has negotiated a payment of $65,002.00 for right-of-way, $108,433.00 for relocation, and $2,200.00 for moving expenses with Charles Franklin Cameron, the property owner of parcel 18, which consists of 0.47 acres lying in Angus Acres II amended, Lot 1, Block 6, Lonestar TWP Subs, Sec. 7, T18N, R15E, Wagoner County. In accordance with a February 10, 2014, Project Construction, Maintenance, Utility Relocation, and Right-of-Way Agreement between the Oklahoma Department of Transportation and the City of Broken Arrow, the City will make the payment to the property owners and apply for reimbursement of ODOT’s 80% share. In accordance with ODOT regulation, relocation and moving costs must be paid the property owner. Payment is on the City Council claims list. Staff recommends that the Council approve Resolution No. 1009 to effect the purchase as well as relocation costs and moving expenses.
Funding for the City’s share of the right of way, relocation, and moving costs will be from the 2014 Streets GO Bond.
Cost: $175,635.00 ($140,508.00 reimbursement from ODOT)
