                     Consideration, discussion, and possible adoption of Ordinance No. 3480 closing a mutual access and utility easement on property located in the Southeast Quarter (SE/4) of Section Two (2), Township Eighteen (18) North, Range Fourteen East, Lot 5, Block 2, Hillside Crossings, a subdivision in the City of Broken Arrow, Tulsa County, State of Oklahoma, generally located north of the Broken Arrow Expressway, a quarter mile west of 9th Street; repealing all ordinances to the contrary; and declaring an emergency (Hillside Crossings Lot 5, Block 2)

End

Background:

The applicant, has submitted an application requesting the closure of a mutual access and utility easement which extends along the east boundary of Lot 5, Block 2 of the Hillside Crossings plat.

 

Lots 4 and 5 of block 2 were combined and subsequently re-divided to create the Hobby Lobby Parcel. The original easement, dedicated by the Hillside Crossings plat, run directly under the Hobby Lobby building. No utilities were placed in this easement so the applicant is proposing to close this easement and dedicate a new one along the east boundary of the new property line. The new dedication will be presented in a separate factsheet. 

 

Oklahoma Natural Gas (ONG), Public Service Company of Oklahoma (PSO), Cox Communications, and Windstream indicate they do not have any problems with the proposed Utility Easement closure. 

 

City staff has reviewed the utility easement closing documents and are in agreement with the closure.  Staff recommends the Council adopt Ordinance No. 3480.
