Background:

The owner, Robert L. and Belinda L. Cacy, have submitted an application requesting the closure of a 17.5-foot utility easement along the west side of the property, which encroaches into the building line setback. This closure is being requested so the waterline can be located west of the building line of the mini storage units. A new dedication of a utility easement is being submitted as a replacement for this closure. The new 17.5-foot utility easement shall be located immediately west of the utility easement requested to be closed and outside the building setback line.

 

Staff has reviewed the documents and recommends acceptance of the utility easement closure.

 

The attached easement closure was previewed by the City Council on March 7, 2017.  Staff recommends the Council Adopt Ordinance No. 3477 and approve the Emergency Clause.
