Background:
On May 26, 2016, the Planning Commission approved BAL 1093, a request to split 13.01 undeveloped acres into two lots. A new library is proposed to be constructed on the west tract, while the east tract will be left for commercial development. Right-of-way has been dedicated along Aspen Avenue in accordance with the Subdivision Regulations, but not along New Orleans Street. In addition, utility easements have not been dedicated along both New Orleans Street and Aspen Avenue per the Subdivision Regulations.

The Planning Commission approved BAL 1093 subject to right-of-way being dedicated along New Orleans Street between Aspen Avenue and Chestnut Avenue in accordance with the Subdivision Regulations (65 feet of right-of-way from the section line that after 350 feet from the point of intersection with Aspen Avenue transitions back at a 30-degree angle to 60 feet). In addition, utility easements were to be dedicated in accordance with the Subdivision Regulations along both New Orleans Street and Aspen Avenue.

The owner, the William K. Warren Medical Research Center, Inc., have submitted an application requesting the acceptance of a utility easement along south side of New Orleans and along the west side of Aspen Avenue in accordance with the Subdivision Regulations as stipulated by the Planning Commission with the approval of BAL 1093.

Staff has reviewed the documents and recommends acceptance of the Utility Easement .
