Background:

The 280-unit Scissortail Apartment project is under construction, about ¼ mile north of Albany Street, on the east side of 23rd Street (County Line Road). The 15.3-acre property is platted as The Park at Albany, which was recorded in December 2013, and approved by the City Council as PUD 217 and BAZ 1878, on July 17, 2012.

The subdivision plat of this tract has a 17.5-foot wide utility easement on its north boundary. The covenants of the plat require all utilities, including electric lines, to be placed underground. The developer, as well as AEP-PSO and other utility companies, have requested that above ground utilities be permitted.

Therefore, a request has been submitted to amend this portion of the covenant, allowing above ground utilities along the north boundary.
