Background:
The Water Construction & Repair Division of the Utilities Department has budgeted for the purchase of a Caterpillar Model 275 C3H3 Skid Steer Loader. A quote has been received from Warren Caterpillar Inc. through the Sourcewell Cooperative Purchasing Contract (formerly NJPA) #011723-CAT, City Membership ID #67325. Funding for this purchase is available in the Broken Arrow Municipal Authority (BAMA) Capital Improvement Fund in the amount of $92,500.00.
Section 2-27(b)(5) of the Broken Arrow Code of Ordinances provides an exception to the competitive bidding process for supplies, materials, equipment, or contractual services purchased at a price not exceeding that set by the state purchasing agency, any other state agency authorized to regulate prices, or from purchasing consortiums.
In addition, Section V.d of the Broken Arrow Purchasing Manual authorizes purchases from "the state contract or other purchasing consortiums," noting that such purchases eliminate the need for formal competitive bidding. Sourcewell qualifies as a purchasing consortium under both the Code of Ordinances and the Purchasing Manual.
The quoted base pricing for the skid steer loader includes a 24-month/2,000-hour full machine warranty. After review, staff has determined that the Caterpillar Model 275 C3H3 Skid Steer Loader from Warren Caterpillar Inc. meets the operational needs of the Division and recommends purchase through the Sourcewell Cooperative Purchasing Contract.
