Background:
BAZ 1944 is a request to change the zoning designation on a 6.50 acre undeveloped tract from A-1 (Agricultural) to CN (Commercial Neighborhood). This property is located on the southeast corner of Jasper Street and Olive Avenue and was annexed into the City Limits of Broken Arrow on September 1, 2015 (Ordinance Number 3363). This site is surrounded on 2 sides (east and west) by properties and residences that are not within the City of Broken Arrow, though these properties are within the Broken Arrow fenceline.

The applicant has not identified any specific uses proposed for the property at this time. In the past, rose plants have been sold on the south part of the property. None of the property has been platted.

The Planning Commission, in their meeting of September 24, 2015, reviewed and unanimously (3-0 vote) recommended approval of BAZ 1944, for CN zoning, based on the Comprehensive Plan and Staff recommendations. There were about 20 people present in the Planning Commission hearing and nine people spoke in opposition, voicing concerns about traffic, property values, loss of green space and street conditions. A 14 page protest petition was submitted to the Planning Commission, opposing this rezoning request. Most of the protestants wanted to know what was the proposed use and what could be built within the requested CN (commercial neighborhood) zoning district.

This site is surrounded on 2 sides by properties and residences that are not within the City of Broken Arrow. Most of the protestants, as well as people signing the petition, reside in areas outside the City limits of Broken Arrow.
