Consideration, discussion, and possible adoption of Ordinance No. 3920 Amending Chapter 23, Traffic, Article I, In General, Section 23-21, Use of mini-bikes, coasters, roller skates, etc., on roadways, of the Broken Arrow Code of Ordinances, prohibiting the operation of motorized scooters on public sidewalks and pedestrian-oriented public spaces within the Rose District; providing exceptions; repealing all ordinances to the contrary; and declaring an emergency
Background:
The Ordinance was previously previewed by the City Council and is now presented for final adoption. The City Council and City Administration have received concerns regarding the operation of motorized scooters on sidewalks and pedestrian areas within the Rose District. Due to the pedestrian-oriented nature of the Rose District, including restaurants, storefronts, outdoor dining, public events, and general pedestrian traffic, the operation of motorized scooters on sidewalks may create conflicts between scooter operators and pedestrians.
The City's existing Code regulates motorized scooters and restricts their use to streets with a speed limit of twenty-five (25) miles per hour or less. State law also authorizes municipalities to regulate the use of motorized scooters on public roadways, trails, sidewalks, and other public spaces.
The proposed ordinance would amend Section 23-21 to prohibit the operation of motorized scooters on public sidewalks, pedestrian walkways, plazas, parklets, public gathering areas, and other pedestrian-oriented public spaces within the Rose District. The proposed ordinance would not prohibit a person from walking, carrying, or otherwise moving a motorized scooter through the Rose District, provided the scooter is not being operated under motor power.
