End

Background:
The Oklahoma Department of Environmental Quality (DEQ) and the Broken Arrow Municipal Authority (Authority) agreed to Consent Order, Case No. 21-248 on April 11, 2021 to address a fish kill caused by an unpermitted discharge from the Authority's Wastewater Collection System. The Order included an assessed penalty of Ten Thousand Dollars ($10,000) and required the Authority to pay Five Thousand Dollars ($5,000) of the assed penalty to DEQ, which was paid on January 20, 2022. The remaining Five Thousand Dollars ($5,000) of the assessed penalty was waived upon the submittal of an approved Supplemental Environmental Project (SEP) plan to total no less than Ten Thousand Dollars ($10,000) and upon the completion of the SEP. The approved SEP included purchasing and Installing an In-Situ Multiparameter Sonde for a continuous water quality monitoring station on Adams Creek and then submitting a final report to DEQ summarizing the findings. ON November 15, 2024, DEQ received the final report from the Authority containing monitoring data from March 2023 through March 2024. The estimated costs pertaining to purchasing and installing the Sonde totaled Ten Thousand Two Hundred Three Dollars ($10,203).
After reviewing the final report, DEQ has determined that the Authority has completed all tasks as required of the Order. Therefore, DEQ is closing Consent Order Case NO. 21-248.
