Background:
This Ordinance amends a previously approved version of the Eligibility for employment section of Chapter 2, Administration, of Article IX, Employee Rules and Regulations, Section 2-146(3).
The purpose of this ordinance amendment is update and clarify the employment eligibility criteria for the City of Broken Arrow. Key updates include:
* A clearer standard for evaluating misdemeanor convictions within the past five years, including examples and criteria for determining unfitness.
* Authority granted to the Human Resources Director to evaluate older misdemeanor convictions for job relevance and rehabilitation.
* Maintains safeguards for ensuring the integrity, safety, and public trust of city operations while promoting fair and transparent hiring practices.
This amendment ensures consistency with modern HR practices and supports both operational needs and legal compliance. The current ordinance prohibits an applicant from being hired if they have any felony, or any misdemeanor involving moral turpitude or which otherwise indicates unfitness for city employment. This broad language indicates any misdemeanor at any point in a person's life may constitute unfitness for employment.
