Notification of the City Manager's execution of an Emergency Services contract with McGuire Brothers Construction for emergency repairs within Horseshoe Acres subdivision

Background:
This Request for Action (RFA) serves as formal notification that the Utilities Department has executed an emergency services contract in accordance with City of Broken Arrow Purchasing Manual, Section XV - Emergency Purchases.
An emergency condition occurred within the Horseshoe Acres subdivision near 6801 S. 136th E. Ave., where an unauthorized and improperly shored excavation conducted by a private contractor, resulted in the collapse of the roadway shoulder and failure of the public sanitary sewer main. City staff responded immediately, established a sewer bypass, and secured the site to protect public health and safety.
Due to the depth of the sewer (20+ ft), instability of the excavation, compromised roadway conditions, and imminent safety hazards, immediate professional repair services were required. McGuire Brothers Construction was solicited to provide emergency shoring, excavation, repair of the damaged sewer line, and backfilling of the affected area. All materials and final ROW surface restoration will be performed by City staff.
The contract was executed as a Not-To-Exceed amount of $45,000, billed at $10,000 per day, with an anticipated duration not exceeding 4.5 days. Due to this value being within the City Manager's execution authority, the contract was immediately executed, and work began on the same day.
City Staff is currently reviewing the options for fiscal reimbursement of the expenditures incurred during the repairs with the appropriate parties involved in the incident.
This notification is submitted to BAMA in accordance with policy, and the executed purchase order is included within.
Cost: $45,000.00
