Background:
Included in Phase IV of the Downtown Main Street Streetscapes is an interactive fountain to be constructed at the Farmers Market adjacent to Main Street between Dallas and Fort Worth Streets. The fountain would be an at-grade series of jets that produce oscillating 6-foot-tall columns of water in various patterns. The water columns would be lighted by color Light Emitting Diodes (LEDs) at night. In the daytime, the fountain could be used by children as a spray playground. Having the jets and lights concealed at grade would allow the fountain to be turned off and the Farmers Market plaza to continue to be used periodically for produce booths and food trailers. The Chamber of Commerce had received the concept design for the fountain from Aquatic Design and Engineering (ADE). R.L. Shears has included the ADE proposal for the fountain design in their proposal for the remaining infrastructure design (plumbing, electrical, water treatment, plaza demolition and buildback). Because of the tight timeframe required to get the fountain functional by next summer, a Professional Consultant Agreement with R.L. Shears Company separate from the Phase IV Downtown Streetscapes has been negotiated and is attached. The agreement for Downtown Main Street Streetscapes Phase IV is a separate agenda item.

Funding for the design and construction work for the fountain will be from Vision 2025 Surplus Funds. Staff recommends that the Council approve the Professional Consultant Agreement and authorize its execution.
